1. Scope of Work
BBJ Hardwood Flooring, LLC (“BBJ,” “we,” or “us”) provides flooring installation, sanding, refinishing, and repair services as specified in the signed estimate or work order. Any changes, additions, or modifications to the scope of work must be agreed upon in writing. Minimum project sizes may apply depending on the service and will be reflected in your estimate.
2. Estimates and Quotes
All estimates are valid for 30 days from the date of issue and are based on an initial visual inspection. If unforeseen subfloor damage, moisture issues, or other structural problems are discovered during the project, we will pause work and discuss any additional costs with you before proceeding.
3. Payment Terms
A deposit of 50% of the project total is due upon signing the work order to reserve your project date and cover initial material costs. The remaining balance is due within 10 days of project completion. We accept cash or check. Payments not received within 30 days of the due date are subject to a late fee of $40. Outstanding balances may result in suspension of work until the account is brought current.
Any materials, tools, or equipment supplied for your project remain the property of BBJ until payment is received in full. As permitted under Wisconsin law, unpaid amounts may be secured by a construction lien against the property; the lien notice required by Wisconsin law is provided with your signed estimate.
4. Cancellation and Rescheduling
If you cancel after signing the work order but before materials have been ordered, your deposit is fully refundable. Once materials have been special-ordered or cut to specification, you are responsible for the cost of those materials, as they cannot be returned. Rescheduling requests made with at least 10 days’ notice before the scheduled start date will be accommodated where possible at no charge. Cancellations or rescheduling requests made within 10 days of the scheduled start date may be subject to a scheduling fee of $100 or 10% of the contract price, whichever is less, plus the cost of any materials already ordered.
5. Customer Obligations & Site Conditions
To ensure optimal installation and finish quality, the customer agrees to provide:
- Climate Control: Operational HVAC maintaining a temperature between 60–80°F and relative humidity between 30–50% for at least 5 days prior to wood delivery and throughout the installation and finishing process.
- Site Access: Unobstructed access to the workspace, electrical power, and water.
- Room Prep: Removal of all furniture, appliances, and personal belongings from the workspace unless furniture moving is explicitly specified in the work order.
- Pets: Securing or removing pets from the work area during working hours.
- Permits: Any permits or inspections required for the work — which are rarely needed for standard flooring — are the responsibility of the property owner.
Installation and refinishing generate dust and noise. While we take reasonable precautions, the customer is responsible for protecting or removing sensitive items from the surrounding area. If a dumpster or additional debris disposal is required, this will be addressed in the work order.
6. Material Acclimation
Wood is a natural material that responds to moisture. For solid hardwood projects, materials must acclimate inside the climate-controlled space according to NWFA guidelines before installation can begin. Delivery and start dates are coordinated accordingly.
7. Warranties and Standards
All work is performed in alignment with National Wood Flooring Association (NWFA) standards. We provide a workmanship warranty of one (1) year on our installation workmanship. This warranty applies only once the project has been paid in full; nonpayment voids all warranties. This warranty does not cover:
- Natural changes in wood color due to sunlight exposure.
- Normal wear and tear, scratching, or denting.
- Damage caused by customer negligence, lack of proper climate control, or moisture intrusion (e.g., flooding).
Materials carry only the warranty (if any) offered by their manufacturer. Where a manufacturer’s warranty exists (for example, on luxury vinyl plank), we will provide it to you. Solid hardwood typically carries no manufacturer warranty.
8. Limitation of Liability
To the fullest extent permitted by law, BBJ’s total liability arising out of or relating to the work performed shall not exceed the total amount paid by the customer under the applicable work order. We shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of use, delay, or damage to items the customer failed to remove from the workspace.
9. Photography and Marketing
With your permission, we may photograph completed work for use in our portfolio, website, and social media, and we may display a small company sign in the yard during the project. No customer names or addresses will be published. You may opt out at any time by notifying us in writing.
10. Dispute Resolution
The parties agree to attempt to resolve any dispute in good faith through direct discussion. If the dispute cannot be resolved that way, the parties agree to attempt mediation before pursuing the matter in the courts of Waukesha County, Wisconsin.
11. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles.
12. Entire Agreement and Changes
The signed work order, together with these Terms of Service, constitutes the entire agreement between the parties and supersedes any prior verbal or written understandings. We may update these terms from time to time; the version in effect at the time your work order is signed governs your project.
